Please read and review our booking terms and conditions carefully before making a booking request with Touch Kailash Travels and Tours, as they outline our respective rights and obligations.
GENERAL BOOKING TERMS AND CONDITIONS
The following booking conditions form the basis of your contract with Touch Kailash Travels and Tours. By making a booking request, you acknowledge that you have read and understood these conditions, including the day-to-day requirements of your chosen tour, and agree to be bound by them. These conditions set out the terms under which we arrange and deliver your travel services. By proceeding with a booking request, you confirm that you understand and accept these terms.
As the traveller, you are responsible for ensuring all payments are made when the booking request is submitted.
OUR SERVICES
Our terms and conditions apply only when you book your entire trip directly through Touch Kailash Travels and Tours, Australia. If you book through an agent or third party, their terms and conditions will apply, and you will be subject to their policies and guidelines.
The services we provide are limited to:
(a) Arranging and coordinating your travel bookings, and
(b) Managing travel arrangements that we directly oversee in collaboration with travel providers in Nepal and Tibet for the Mount Kailash Yatra.
YOUR DETAILS
At the time of booking, passenger names must be provided exactly as they appear on your passport, including middle names. A copy of your passport must be submitted at the time of booking. Any spelling corrections required after the deposit has been paid must be requested in writing. If incorrect details are provided and require re-issuing of documentation, you will be responsible for any associated fees, including reasonable administrative charges.
YOUR OBLIGATION TO CHECK DETAILS
You must carefully review your confirmation invoice as soon as you receive it. If any details appear incorrect or incomplete, contact us immediately, as changes may not be possible later.
We cannot accept responsibility for errors unless we are notified within five days of issuing your confirmation. We will do our best to rectify any mistakes brought to our attention after this period, but any associated costs will be your responsibility. If you need to change or cancel arrangements later, amendment or cancellation fees may apply (refer to "Amendments by You" and "Cancellations by You" sections).
PAYMENTS
Deposit: A non-refundable deposit of 20% per person is required within seven days of making your booking request. Services are not guaranteed until the deposit is received, and prices may change if payment is delayed. We reserve the right to adjust prices in response to external circumstances, and you acknowledge that we are not liable for such changes. Any price adjustments will be advised at the time of quotation.
Balance Payment: The final balance must be paid no later than 90 days before the confirmed tour departure date. You are responsible for purchasing your airfare as soon as possible after your tour date is confirmed. We do not take responsibility for airfare bookings.
If full payment is not received on time, we reserve the right to cancel your booking, apply cancellation fees, and withhold the deposit. (See "Trip Cancellations" below).
Mode of Payment
Payments must be made directly into the Touch Kailash Travels and Tours bank account. Banking details and payment instructions will be provided with the booking form.
AMENDMENTS BY YOU
We will make reasonable efforts to accommodate any amendments or additional requests, though these may not always be possible. For group departures, transferring a booking to a different departure date is considered a cancellation. You may also be required to cover any additional costs resulting from changes made after the booking is confirmed.
AMENDMENTS BY US
Prior to Travel:
We may need to make changes to your itinerary before your trip starts. If any significant alterations occur, we will notify you within a reasonable time frame.
During Travel:
Changes to itineraries, transport, accommodation, and inclusions may occur due to factors beyond our control, such as road conditions, adverse weather, transport delays, or vehicle breakdowns. If alternative arrangements incur additional costs, you agree to cover these expenses.
General:
To the fullest extent permitted by law, we are not liable for any omissions or modifications due to force majeure events or circumstances beyond our control. This includes any inconvenience or loss of enjoyment caused by changes.
RISK AND LIABILITIES
You should refer to the Department of Foreign Affairs and Trade (DFAT) for travel advice regarding your destinations. Your decision to travel is made with an understanding of the risks involved, and we disclaim liability to the maximum extent permitted by law.
Cancellation & Postponement Fees
Cancellations or postponements must be provided in writing at least 45 days before the departure date. Charges depend on external suppliers, primarily in Tibet for the Mount Kailash Yatra.
Cancellation charges:
- More than 90 days before departure: Loss of deposit
- 45 days or less before departure: 50% of total cost
- No show: 100% of total cost
For cancellations within 45 days of departure, a 50% trip cost will be charged, in addition to the 20% non-refundable deposit and an extra USD 200 fee.
Once your tour has commenced, no refunds will be provided for unused services. If you are denied service due to incomplete COVID-19 vaccination requirements, you will not be entitled to a refund.
FLIGHT DELAYS & CANCELLATIONS
Flight delays and cancellations are common in remote areas such as Simikot, Everest, and Annapurna due to weather conditions. While we strive to adhere to scheduled times, we cannot guarantee them. We recommend budgeting for additional accommodation and meal expenses in case of delays.
FORCE MAJEURE
We are not responsible for delays or cancellations resulting from events beyond our control, including but not limited to:
- Natural disasters (floods, earthquakes, landslides)
- Extreme weather conditions
- War, civil unrest, industrial disputes
- Epidemics, pandemics, or government restrictions
If we must cancel or reschedule your trip due to force majeure, we will offer alternative arrangements or a refund, minus reasonable deductions for costs already incurred.
HEALTH REQUIREMENTS
By Tibetan government regulations, travellers aged 70 and above are not permitted to visit the Kailash region. Travel in these areas is at your own risk. We may request a medical assessment from your doctor before confirming your booking.
It is your responsibility to ensure you are physically fit for the trip. Any undisclosed health conditions may result in cancellation of your booking.
TRAVEL INSURANCE
We strongly recommend securing comprehensive travel insurance, including cover for cancellations, medical emergencies, lost baggage, emergency evacuations, and adventure activities at high altitudes.
Your insurance should be arranged at the time of booking to protect against cancellation fees.
REFUSAL OF CARRIAGE
We reserve the right to remove customers from group tours if they engage in behaviour that impacts the safety or enjoyment of others, including:
- Physical, medical, or mental inability to participate
- Disorderly conduct
- Possession of prohibited substances or items
No refunds will be provided in such cases, and you will be responsible for any additional expenses incurred.
ACCOMMODATION POLICY
Accommodation varies from standard hotels to basic guesthouses. Facilities in some locations may be minimal, and shared amenities are common. Bedding is typically provided but may not meet Western standards, particularly in remote regions.
Upgraded accommodation options are available in Kathmandu at an additional cost.
TRAVEL DOCUMENTS & VISAS
Your passport must be valid for at least six months beyond your return date to Australia, with at least two blank pages. Non-Australian passport holders may require additional documentation and fees.
We do not issue Nepal visas; these must be obtained via the Nepalese Embassy or online. We assist with Tibet visa applications but cannot guarantee approval.
